What is ArtResolve?

ArtResolve is a non-profit making company limited by guarantee whose application for charitable status is currently pending. ArtResolve offers efficient and private out-of-court options for the resolution of disputes about works of art, objects of antiquity and historic sites. 
  • These disputes may involve authenticity and attribution, title and provenance, broken trusts or other promises, liability for loss or damage, copyright and moral rights, matters of insurance and indemnity, or any other question concerning cultural objects or rights. 
  • They often involve complex points of law and star conflicts of evidence. 
  • Court claims can be very expensive, consume much valuable time, generate harmful publicity and, in the end, satisfy none of the parties. 
  • The dispute resolution methods on which ArtResolve advises can help greatly in avoiding these problems.

WIDE SPECTRUM OF CONFIDENTIAL SYSTEMS

ArtResolve offers a wide spectrum of confidential systems for the resolution of art-related claims. These are : ArtResolve recommends mediation first, as an agreement is the most satisfactory method of resolving disputes. An early neutral evaluation may well help to provide the basis for an agreement. But achieving a settlement depends on securing the agreement of the parties. To avoid a court case where no settlement is reached, Art Resolve offers a choice of two private binding systems, expert determination and arbitration. ArtResolve has evolved its own rules for mediation, early neutral evaluation and expert determination, and recommends the UNCITRAL arbitration rules used in conjunction with ArtResolve to appoint the tribunal. Whichever system is used, the process is confidential and impartial, and,. compared with court cases, more economical of both time and money.

DISPUTES RESOLVED WITH THE HELP OF TRAINED SPECIALISTS

Art Resolve has access to lawyers, art experts, archaeologists and historians. They have been selected for their professional expertise and experience, and for their specialised knowledge. ArtResolve regards the selection of these neutrals as being of the first importance, and seeks always to appoint the most suitable person(s) for each case and the most acceptable to the parties. In appropriate cases, ArtResolve can offer experts drawn from different professions: these experts can form a panel able to consider a dispute from the artistic, histoircal and legal angles. This gives ArtResolve a particular edge in dealing with issues such as authenticity, title and the special problems arising from disputes about Holocaust assets.

EXISTING OR FUTURE DISPUTES

In the case of disputes arising out of past events, a special agreement needs to be entered into between the parties for the resolution of the dispute: ArtResolve offers a model agreement for this purpose. ArtResolve also offers a model clause for future disputes, to be used with agreements for transactions such as the sale, loan, pledge, mortgage, insurance, repair, restoration and carriage of works of art.
